Agreement
Welcome to ClickInks.com (hereinafter "ClickInks," "Company" or "Site"). By using this Site, you agree to be bound by and comply with these terms and conditions ("Terms and Conditions"). You also agree to comply with any guidelines or rules posted on the Site regarding any product or service offered on the Site. All such guidelines and rules posted are hereby incorporated by reference into these Terms and Conditions. Please read them carefully. If you are dissatisfied with the Site, its content or Terms or Conditions, you agree that your sole and exclusive remedy is to discontinue using this Site. PLEASE NOTE: We reserve the right, at our sole discretion, to change, modify or otherwise alter these Terms and Conditions at any time. Unless otherwise indicated, amendments will become effective immediately. Please review these Terms and Conditions periodically. Your continued use of the Site following the posting of changes and/or modifications will constitute your acceptance of the revised Terms and Conditions.
Communications
When you visit ClickInks, purchase products through the Site, or email the Company, you are communicating with us electronically. You consent to receiving communications from us electronically. We will communicate with you via email or by posting notices on and updates to the Site. By using the Site, you hereby agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. We welcome your feedback about the Site, however, any comments, ideas, notes, messages, suggestions or other communications sent to the Site shall be and remain the exclusive property of the Company, and we may use all such communications in any manner, including reproducing, disclosing and publishing such communications, all without compensation to you.
Confirming, Cancelling and Changing your orders
For orders that have already been shipped, you can confirm the date and method of shipment, and obtain an estimated date of arrival by calling our Customer Care Center at 833-534-8415 or via email at [email protected]. If your order has not yet entered the shipping process, you can change the details by calling the Customer Care Center. Company will not provide reimbursement for shipping and handling charges once the order has entered the shipping process. Refer to shipping link for further details on changing address after package has shipped.
Please call or email immediately if any changes need to be made. You must allow 24 hours, or 1 business day, for the message to be processed. If your order has already entered the shipping process, or has shipped out from our warehouse, an address change or refusal of order will be assessed a 20% restocking fee, as well as any additional shipping costs incurred by Clickinks, the shipper.
Order and Payment Terms
You agree that your placement of any order on the Site is sufficient to satisfy the Statute of Frauds, and no further notification is required. Terms of payment are within Company's sole discretion, and unless otherwise agreed in writing, payment must be received by Company prior to acceptance of an order. Company may accept payment via Visa, MasterCard, Discover and American Express (other forms of payment may be added or removed at Company's sole discretion).
Orders are not binding until the order is accepted by Company and Company may cancel or limit an order any time after it has been placed in its sole discretion. Company expressly conditions its acceptance of your order on your agreement to these Terms and Conditions, Site Terms and the terms of the membership, as applicable.
Shipping
Unless otherwise noted, Company will make best efforts to ship merchandise within 7 to 10 days of the receipt of a properly completed order, but this is only an estimate. Because of this we have a 15 business day waiting period before any product will be resent. Product availability may be limited and particular products may not be available for immediate delivery, even if the product is not identified as "out of stock" on the Site. Company shall not be liable for any loss, damage, cost or expense related to any delay in shipment or delivery. Company may opt to transfer title to any product and risk of loss passes from Company to you upon shipment from Company's facility.
Please assure you enter a correct street address that can accept deliveries from USPS and DHL/Fedex. DHL/Fedex does not deliver to P.O. Boxes, therefore P.O.Boxes are shipped USPS Priority mail which is extra. If an order is returned to us because no deliveries can be made by either DHL/Fedex or USPS, store credit less actual shipping charges (can be $19.95 due to re-shipping) will be incurred. Shipping charges must be paid prior to re-delivery to a new address.
ClickInks Return Policy
All returned cartridges must be at least seventy percent (70%) filled (which we feel is sufficient to enable a fair test of the quality of the product) and in like new condition. In the event that the troubleshooting is unsuccessful, please call our customer service department at 1-833-534-8415 and we will be better able to assist you.
**Please note that a RMA (Return Merchandise Authorization) is REQUIRED to be included with all returns. In order to obtain this authorization you need to contact our customer service department.
We accept non-OEM remanufactured or compatible cartridges for return under the following policy. Returns for refunds for thirty days from the date of shipment as long as the cartridge is seventy (70%) percent filled, we also accept opened cartridges that are at least seventy (70%) percent filled for 30 days from date of shipment, unopened product or product that can not function can be returned up to 30 days. After 30 days from the date of shipment and up to 180 days only unopened cartridges can be returned and will be subject to a 20% restocking fee. Any cartridges returned outside of this policy will not be accepted for any kind of credit.
You must notify us within 2 weeks of the date your order was shipped if you believe any remanufactured or compatible cartridge is defective. If we determine that you have received a defective cartridge, we will provide a shipping label. If you are out of the time frame, or are returning a product not determined to be defective, you are responsible for the shipping charges to return the item.
OEM (Original Equipment Manufacturer/Name Brand) products are covered by the manufacturer. If you have a product that is defective, please contact the manufacturer (i.e. Epson, Hewlett Packard, Canon, Lexmark, etc.) to verify their manufacturers' warranty. If the OEM product is not defective and has not been opened or damaged you can return the product at your own expense within 60 days from date of shipment for a refund, less a 20% restocking fee.
ClickInks is not responsible for returned items outside of the return policy timeframe, any cartridges returned after this time will be property of ClickInks.
It is our policy that all returned cartridges must be at least seventy (70%) percent filled. We feel that this gives everyone a fair test of the quality of the product. Unfortunately, in our experience some people have used the entire cartridge and then sent it back asking for a refund. If a returned cartridge is less than 70% filled, we will contact you for further instructions.
Because some of our customers have requested new products without returning their defective merchandise, we are unable to ship or make refunds/credits until we receive the products being returned. If you need a replacement product right away, we suggest you ask for a refund and place a new order. Your new order will be processed upon payment.
Please allow standard shipping timing of 3-5 business days for your return to arrive in our Returns Department and up to 7 business days to process your return from the time it reaches our Returns Department. All credit requests will be completed within one to two billing periods, but please note that it may take your credit card bank up to 30 days to apply your credit. Please note that we have no control over how long the credit card company takes to credit the refund to your account after we submit the data to them, but we do whatever we can to expedite the process.
Coupon Redemption
All coupons have an expiration date and may be limited to one per person and may not be valid on OEM products.
Returns/exchanges on promotional items
Buy 2 get 1 free and Buy 3 get 1 free promotions require that all free products that were shipped must be returned. Any product received above and beyond the free product will be eligible for normal refund/exchange guidelines.
If you purchase a combo pack and wish to do a return or refund, we the company will divide the price of the combo pack by the number of units included in the combo pack (including free promotional items) to get a per cartridge price. We will then multiply the number of units returned by the unit price previously calculated. If the quantity being returned is less than total combo pack then we will assess a 20% usage fee toward the total refund amount.
If you wish to exchange a product that you purchased at a promotional price you will be required to pay the difference between the new order and the previous order.
If a portion of your order was paid for using a discount code or loyalty points, these discounts and loyalty points will be returned to your original account and will be not be refunded. You are welcome to use these discounts or loyalty points toward future purchases.
Shipping charges on refunds/exchanges
If you are charged shipping on your original order then this shipping charge cannot be refunded. In no instance will shipping be refunded.
If you are not charged shipping on your original order then a $6.95 shipping and handling fee will be assessed. This is included on all store credits and refunds.
When returning an item for exchange or refund, ClickInks is not responsible for product making it back to our warehouse. It would be up to you as the consumer to place any desired insurance on items being shipped back to our warehouse. If there is no tracking number placed on return product and item does not make it back to our warehouse, ClickInks cannot be held liable for lost product.
Limited Warranty of Product and Site
The limited warranty and returns policy provided does not include malfunctions or failures resulting from misuse, abuse, neglect, alteration, problems with electrical power, improper storage, extreme temperatures, acts of nature or improper installation or repairs. Such limited warranty only extends to refunds or replacements of ClickInks Products. Clickinks is not responsible for damages arising in your printer, computer systems or other belongings that may come in contact with ink cartridges.
No advice or information, whether oral or written, obtained from us or the Site shall create any warranty not expressly stated in these terms and conditions.
You expressly understand and agree that the products and services provided are on an as is and as available basis.
Company attempts to be as accurate as possible with our product descriptions however Company does not warrant that product descriptions or other content of this site is complete, current or error-free.
Prices, availability and promotions listed on this site are subject to change without notice.
You should note that product comparisons on Site or in Company communications do not imply that all products are exactly comparable.
In the event a product is listed at an incorrect price due to typographical error, Company shall have the right to change pricing, refuse or cancel any orders placed at the incorrect price whether or not the order has been confirmed and your credit card charged.
You accept full responsibility for keeping your account password confidential, restricting access to your computer and keeping the e-mail address associated with your account current. You are personally liable for any orders that you place or charges that you incur.
Periodically links may be established from Site to one or more external web sites, these links are provided for your convenience only. None of such links should be deemed to imply that Company endorses the Third Party Sites or any content therein.
If any provision of these Terms and Conditions is held to be invalid or unenforceable, the provision shall be interpreted in a manner that is enforceable, and the remaining provisions shall be enforced.
Magnuson Moss Warranty Act
Worried about your printer warranty? Don't be. According to the Magnuson Moss Warranty Act no warranty may be voided by the use of compatible Non-OEM products.
Legally, this is a law that states that
"No warrantor of a consumer product may condition his written or implied warranty of such product on the consumer's using, in connection with such product, any article or service (other than article or service provided without charge under the terms of the warranty) which is identified by brand, trade or corporate name".
ClickInks Return Policy
If you would like to return merchandise, we do ask that you first visit our Support Center and follow the self-serve options to troubleshoot your cartridges.

Refunds

If at any point during the first thirty days from the date of shipment you wish to receive full refund (except OEM's) you can contact customer service at 833-534-8415 for further assistance.
If product is beyond thirty days from original purchase date, no refund option is available. Refer to the exchange policy listed below

If you have elected not to wait for an item that is out of stock, we will refund your money however please be advised this process may take one to two billing periods for credit to be applied to your card.
Exchanges
No exchange will be processed until we have product which you are requesting to be exchanged in our possession
Opened product out side of the thirty day full refund time period is still eligible for exchange up to 90 days from the date of shipment. If you wish to exchange this product please call our customer service at 833-534-8415 for further assistance.

A restocking fee of 20% will be assessed on all orders that are returned after 30 days and product is NOT opened.
